Terms of Service

1. Overview

These Terms of Service ("Terms") govern your use of the Flaxu platform ("Service"). By using the Service, you are deemed to have accepted these Terms. Flaxu is a SaaS platform that allows you to deploy AI assistants with 34 specialist agents across various communication channels (WhatsApp, Telegram, Discord, Slack, Web Widget).

2. Account Creation and Security

You are required to create an account to use the Service. During account creation:

• You must provide accurate and up-to-date information.
• You are responsible for the security of your account.
• You must not share your password with anyone.
• You are responsible for all activity on your account.
• You must be over 18 years of age.

3. Subscription Plans and Payments

Flaxu offers two subscription plans:

• Starter Plan: $9/month or $90/year. All AI models, all channels, 3 channel limit. You use your own API keys.
• Pro Plan: $29/month or $290/year. Everything in Starter + Claude Max included, 5 channel limit, no API key required.

Payments are processed securely through Lemon Squeezy. As Merchant of Record, Lemon Squeezy automatically handles tax and VAT processing. Subscriptions renew automatically and can be canceled at any time.

4. Usage Rules

You must comply with the following rules when using the Service:

• You may not use the Service for illegal purposes.
• You may not use it to create spam, fraud, or harmful content.
• You must avoid actions that would disrupt other users' service.
• You must store your API keys securely.
• You may not engage in reverse engineering, source code extraction, or attempts to copy the platform.
• You must also comply with the terms of use of third-party API providers (Anthropic, OpenAI, Google).

5. API Keys and Data Security

Starter plan users provide their own API keys. These keys are stored encrypted and are never displayed in plain text. However, you are responsible for the security of your API keys. For Pro plan users, Claude models are provided through our platform's enterprise account.

6. Intellectual Property

The Flaxu platform and all related intellectual property rights belong to Flaxu. Content and data you create through the Service belong to you. Flaxu has the right to process your data to the extent necessary for providing the service.

7. Service Level Agreement

Flaxu targets 99.9% uptime. However, interruptions may occur due to maintenance work, updates, or unexpected technical issues. Scheduled maintenance will be announced in advance. The Service is provided "as is" and uninterrupted operation is not guaranteed.

8. Account Suspension and Termination

In the event of a violation of the Terms of Service, Flaxu reserves the right to suspend or terminate your account without prior notice. Upon account termination, your data will be permanently deleted within 30 days. You may cancel your subscription at any time; you will continue to use the service until the end of your current billing period.

9. Limitation of Liability

Flaxu is not liable for indirect, special, or consequential damages arising from the use of the Service. Content generated by AI models is for informational purposes and does not substitute professional advice. Our total liability is limited to the subscription fee you have paid in the last 12 months.

10. Changes

These Terms of Service may be updated from time to time. Significant changes will be communicated via email. Your continued use of the Service after changes constitutes acceptance of the updated terms.
